    Mein Händler hat bei der Lieferung des Touaregs den Audi aus meinem beendeten Leasing mitgenommen und bei sich auf den Hof gestellt. es wurde keine Übergabe gemacht. Der Audi war gewaschen und innen gereinigt. Es gab lediglich an der vorderen und hinteren Stossstange eine kleinen ca. 2 cm langen, nicht tiefen und kaum sichtbaren Kratzer. Keine Dellen oder Lackschäden.

    Mit der Leasingfirma war vereinbart, sie würden den Audi beim Händler abholen lassen.

    Einen Monat stand der Audi nun bei dem Händler öffentlich zugänglich auf dem Hof zwischen den anderen Gebrauchten.

    Der Audi wurde abgeholt und gesichtet. Dabei wurden Kratzer und Dellen vermerkt welche nicht durch mich verursacht wurden. Nun möchte die Leasingfirma von mir 1200 Euro für die Reparatur.

    Das kann doch nicht angehen oder ? Ist es richtig das die Reparaturkosten berechnet werden? Ist es nicht üblich 10% des Wertverlustet zu berechen ?

    Das nimmt kein Ende oder ?
    Haben wir Juristen hier welche mich via PN mal aufklären können ?

    War doch bestimmt Jenny mit dabei. :Applause:
    Ansonsten würde ich mal bei cartop, oder so ähnlich, anfragen, die sind auf solche Kleinigkeiten spezialisiert, verlangen nur einen Bruchteil von dem, was Vertragswerkstätten haben wollen. Wahrscheinlich lässt die Leasingbude es dann auch nur so reparieren und streicht satt ein.

    Then both of you are having a kind of problem.
    - You can't prove that you didn't make that damage.
    - But also the leasing company can't prove you did.

    I think that both of you have to get together and discus this issue. It's their fault that they didn't pick up the car sooner. Normally the dealer has to make the transfer document and send that to the leasing company within 2-5 days. The leasing company should have asked/instructed the dealer to make a transfer document when you brought in the Audi AND they should have asked him to send it in. If they didn't do this, they can't prove you made the damage, but in the mean time you can’t prove you didn't and that’s worse. Normally you had to ask yourself to get a transfer document, this is mentioned in most contracts or in the "little letters chapter". Check this out first and if this isn't in, you have a point to make.

    I would try to work this out and tell them you washed and vacuum cleaned the car when you brought it in and that the mentioned damage wasn't in it at the time you made the swap at the dealer.
